Expert Advice

Payment disputes in construction projects can arise quickly and often require immediate action. Smash and grab adjudication is a fast-track legal process designed to recover unpaid sums where a valid payment application has been submitted and the paying party has failed to issue a compliant payment notice or pay less notice.

Early legal advice allows us to assess the validity of your payment application, review contractual terms, and determine whether adjudication is the appropriate course of action. Acting promptly helps maximise the prospects of recovery and ensures your position is protected.

Blackstone Solicitors offers expert advice and guidance on all aspects of smash and grab adjudication. We understand the pressures of cash flow within the construction industry and work to achieve swift and effective outcomes.

Every matter is unique and requires careful assessment to determine the most appropriate legal strategy and whether adjudication is the right approach.

      Understanding Smash and Grab Adjudication

Smash and grab adjudication focuses on the technical compliance of the payment process rather than the underlying value of the works. Where a valid payment application has been submitted and the responding party has failed to comply with contractual or statutory requirements, the paying party may be required to pay the full amount applied for.

While this process can result in rapid recovery of sums due, it does not determine the true value of the works. This means further adjudication or dispute resolution may arise at a later stage.

      Structuring and Advancing Claims

At Blackstone Solicitors, we carefully review payment applications, contractual provisions, and project documentation to determine whether a smash and grab adjudication is available and appropriate.

Our team acts efficiently and professionally to ensure all procedural requirements are met and claims are presented clearly and effectively. We focus on achieving swift outcomes while minimising risk and disruption to your business.

It is important to seek advice from experienced construction solicitors. The right legal team will identify whether the necessary conditions are satisfied and guide you through the process to protect your interests.
